dismissed — Tennessee ethics complaint alleging illegal PAC coordination with Bobby Harshbarger campaign

campaign-finance · 2024-04-26 · State Sen. Ken Yager filed a complaint with the Tennessee Bureau of Ethics and Campaign Finance in late April 2024 alleging that Rep. Diana Harshbarger, her son (state Senate candidate Bobby Harshbarger), and the political action committee East Tennessee Conservatives (ETC PAC) illegally coordinated campaign activity. The complaint cited that ETC PAC and Rep. Harshbarger's congressional campaign shared the same treasurer, Thomas Datwyler, and that the Datwyler-run ETC PAC spent more than $500,000 on mailers and texts attacking incumbent state Sen. Jon Lundberg, whom Bobby Harshbarger went on to defeat in the August 2024 GOP primary. Tennessee's Registry of Election Finance (TREF) voted in June 2024 to refer the matter to Attorney General Jonathan Skrmetti for investigation. In October 2024, the Attorney General's office reported that it found 'no factual or legal basis to support the allegations of improper coordination,' noting that emails between Datwyler and Harshbarger's campaign did not discuss the PAC. Some TREF board members pushed to subpoena Datwyler despite the findings, but the complaint was ultimately dismissed in spring 2025 at Yager's own request. · Dismissed; Tennessee Attorney General's office found no factual or legal basis for the coordination allegations, and the original complainant asked the Registry of Election Finance to drop the matter in spring 2025.
