resolved — FEC ADR 217/218 (MUR 5498/5554): Campaign Disclaimer Violations — Case for Congress
Complainants filed FEC complaints alleging that Case for Congress — Ed Case's 2004 re-election campaign committee for Hawaii's 2nd congressional district — failed to include legally required 'Paid for by' disclaimers on yard signs, banners, campaign literature, and the campaign website, violating 2 U.S.C. §441d(a) and 11 CFR 110.11(a) and (c). The Commission voted 6-0 to refer the consolidated matters (MUR 5498/ADR 217 and MUR 5554/ADR 218) to its Alternative Dispute Resolution office. A negotiated settlement was reached: committee treasurer James H. Case paid a $1,500 civil penalty; Case for Congress was required to attend an FEC seminar and develop an FEC Compliance Manual. The case was closed on March 14, 2005.
