pending — Federal indictment for assaulting/impeding federal officers at Delaney Hall ICE facility
On May 9, 2025, McIver conducted a congressional oversight visit to the Delaney Hall ICE detention facility in Newark with Reps. Bonnie Watson Coleman and Rob Menendez. During a confrontation as Newark Mayor Ras Baraka was being arrested for trespassing, prosecutors allege McIver slammed her forearm into a federal agent, grabbed an agent to restrain him, and pushed an ICE officer. Interim U.S. Attorney Alina Habba announced charges on May 19, 2025, and a federal grand jury returned a three-count indictment on June 10, 2025, charging her under 18 U.S.C. Section 111(a)(1) with assaulting, resisting, impeding, and interfering with federal officers (two counts carry up to 8 years each and one count up to 1 year). McIver pleaded not guilty and characterized the prosecution as a politically motivated attempt to criminalize congressional oversight. She rejected a plea deal. The district court denied her motions to dismiss (based on vindictive/selective prosecution and legislative immunity) on November 13, 2025; she filed an interlocutory appeal to the Third Circuit, where oral arguments are scheduled for June 23, 2026. The case remains unresolved.
