In 2002, Scott Perry — then secretary-treasurer of Hydrotech Mechanical Services Inc., a mechanical contracting company he co-founded — faced criminal charges in York County, Pennsylvania, for conspiring to falsify state-mandated sewage discharge monitoring reports submitted to the Pennsylvania Department of Environmental Protection. The reports concerned levels of chlorine and acidity in water discharged into Stony Run Creek from the Mesco plant, where Hydrotech held a maintenance contract. Perry and two other men were charged. In November 2003, Perry entered Pennsylvania's Accelerated Rehabilitative Disposition (ARD) first-offender program and entered a no-contest plea; the charges were dropped upon successful completion of the ARD year. Hydrotech paid a $5,000 fine. Perry subsequently stated the incident was 'cavalier' but not criminal, and that Hydrotech had originally brought the issue to DEP's attention.
