resolved — OCE Referral and House Ethics Committee Review — STOCK Act Periodic Transaction Report Failures
The Campaign Legal Center filed a complaint with the OCE alleging Rep. Suozzi failed to file Periodic Transaction Reports (PTRs) as required by the STOCK Act for approximately 300 stock trades made between 2017 and 2020, with a total value estimated between $3.2 million and $11 million. The OCE transmitted a formal referral to the House Committee on Ethics on February 28, 2022. On July 29, 2022, the Committee unanimously voted to dismiss the referral, concluding there was no clear evidence the omissions were knowing or willful, that the members were generally unclear on PTR requirements, and that Suozzi had made remedial efforts. Suozzi did not return to the House after this dismissal (he had left to run for New York governor), returning later via 2024 special election.
resolved — FEC Administrative Fine for Failure to File 48-Hour Notification Reports (AF 4224) business
The FEC found that Suozzi for Congress and its treasurer Michael G. Norman violated 52 U.S.C. § 30104(a) by failing to timely file required 48-hour notification reports for the 2020 election cycle. The Commission voted 5-0 to assess a civil penalty of $13,525 on August 11, 2021. The committee challenged the finding on September 20, 2021, but the penalty was upheld on December 8, 2021, and paid in full by February 1, 2022.
resolved — FEC Alternative Dispute Resolution Settlement for Failure to Refund Excessive Contributions (ADR 1172) business
Suozzi for Congress and its treasurer Michael G. Norman were referred for failing to remedy excessive contributions from the 2022 primary and general election cycles within permissible timeframes, including $9,905 in contributions designated for the 2022 general election that were not refunded after Suozzi withdrew from the 2022 primary. Violations cited under 52 U.S.C. § 30116(a) and 11 CFR 110.1(b). Attributed to a staffing change and technical difficulties with reporting software. The FEC voted 6-0 to approve a negotiated settlement on October 30, 2024, requiring a $4,075 civil penalty and annual compliance firm certification for two years.
